Terms of Use — GymNotes

1. Acceptance of Terms

Welcome to GymNotes("GymNotes", "we", "our", or "us").
By downloading, installing, or using the GymNotes mobile application on iOS or Android, you agree to these Terms of Use ("Terms").

If you do not agree to these Terms, do not use the app.

2. Eligibility

You may use GymNotes only if you can legally enter into a binding agreement under applicable law.
If you are under the age of majority in your jurisdiction, you must use GymNotes with permission of a parent or legal guardian.

3. License to Use the App

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use GymNotes for personal, non-commercial use.

You may not:

  • copy, modify, distribute, sell, lease, sublicense, or reverse engineer the app, except where permitted by law;
  • use the app for unlawful, abusive, or fraudulent activity;
  • attempt to interfere with app security, availability, or integrity.

All rights not expressly granted are reserved by us.

4. App Features and Service Scope

GymNotes provides workout tracking and gym note functionality, including:

  • muscle groups and exercise tracking (weight, sets, reps, notes);
  • body measurements and daily body-weight logging;
  • photos, GIFs, and videos attached to exercises or groups;
  • optional GIF library downloads;
  • export and import of workout data backups;
  • optional paid subscriptions to remove ads.

Features may change over time. We may add, modify, or remove features at any time.

5. User Content

You are responsible for content you add to GymNotes, including exercise names, notes, measurements, and media.

You agree not to submit content that:

  • violates applicable law;
  • infringes intellectual property or privacy rights;
  • contains harmful, abusive, discriminatory, or illegal material.

You retain ownership of your content. Workout data is stored on your device unless you export or share it yourself.

6. Subscriptions, Billing, and Ads

GymNotes may offer a free plan with ads and paid plans (for example monthly or one-time purchase) that remove ads.

  • Payments are processed by Apple App Store or Google Play.
  • Subscriptions auto-renew unless cancelled before renewal, as allowed by store rules.
  • Pricing may change as permitted by platform rules and applicable law.
  • For billing, refunds, and cancellations, the applicable store policies control.

7. Third-Party Services

GymNotes may rely on third-party services, including:

  • Apple App Store / Google Play (distribution, payments, ads on free plan);
  • GitHub (optional exercise GIF library downloads);
  • Expo/EAS and related infrastructure services.

Your use of those services may be subject to their own terms and privacy policies.

8. Privacy

Your use of GymNotes is also governed by our Privacy Policy.

By using GymNotes, you acknowledge that processing described in the Privacy Policy may occur.

9. Intellectual Property

The app, branding, software, UI, and related materials (excluding your own content) are owned by us or our licensors and protected by applicable intellectual property laws.

You may not use our name, logo, or brand assets without prior written permission.

10. Acceptable Use and Restrictions

You agree not to:

  • use GymNotes to violate any law or regulation;
  • upload malware, attempt unauthorized access, or disrupt services;
  • scrape, harvest, or collect data from the app in unauthorized ways;
  • use GymNotes in ways that could harm you or others (for example unsafe training advice).

We may limit or suspend access if we reasonably believe these Terms are violated.

11. Health Disclaimer

GymNotes is a workout logging tool only. It does not provide medical, nutritional, or professional fitness advice. Consult a qualified professional before starting or changing an exercise program.

12. Disclaimers

GymNotes is provided on an "as is" and "as available" basis, to the fullest extent permitted by law.

We do not guarantee that the app will be uninterrupted, error-free, or that all data will always be available.

13. Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill resulting from your use of GymNotes.

If liability cannot be excluded, our total liability is limited to the amount you paid for GymNotes in the 12 months before the event giving rise to the claim (or USD 50 if greater).

This does not limit liability where prohibited by law.

14. Indemnification

You agree to defend, indemnify, and hold harmless GymNotes and its operators from claims, liabilities, damages, and expenses arising from your misuse of the app, violation of these Terms, or violation of third-party rights or applicable law.

15. Termination

You may stop using GymNotes at any time.

We may suspend or terminate access if we believe you violated these Terms or if required for legal or security reasons.

16. Changes to These Terms

We may update these Terms from time to time and revise the "Last Updated" date.

Your continued use of GymNotes after updates means you accept the revised Terms.

17. Governing Law

These Terms are governed by applicable laws of the jurisdiction where the app operator is established, unless mandatory consumer protection laws in your place of residence provide otherwise.

These Terms of Use apply to GymNotes version 0.0.7 and above on iOS and Android. The legal text is provided in English.
